Medical Release and Authorization

In the event emergency medical aid/treatment is required due to illness or injury while being on the property of the agency, I authorize SoléAna Stables and/or Silver Spur Stables to:

  • Secure and retain medical treatment and transportation, if needed.
  • Release participant records upon request to the authorized individual agency involved in the medical emergency treatment.

Consent Plan

This authorization includes x-ray, surgery, hospitalization, medication, and any treatment procedure deemed "lifesaving" by the physician. This provision will only be invoked if the person listed as “emergency contact” is unable to be reached. I agree to pay for or arrange insurance payment for costs and claims SoléAna Stables/Silver Spur Stables incurs or becomes liable to pay for all medical aid, treatment, and procedures arising from any illness or injury covered by this authorization.

Confidentiality - For Lesson Volunteers: All participant records are considered confidential and can only be accessed by a staff member. If you feel you need more information about a participant you work with, please take the time to learn more about the participant by checking the Participant Profile Binder. Do not hesitate to ask the instructor before class if you have additional questions.

Please keep any information you learn about a participant to yourself and use for class only. Ask before taking pictures.

Attendance - For Lesson Volunteers: Regular attendance is very important to the success of our Participants and program. Lessons may need to be canceled due to lack of Volunteers, causing disappointment and distress to the Participants. Some have asked if they can volunteer for two lessons in a row and the answer is YES!

Friendships at the Barn - For Lesson Volunteers: Please make lots of friends, make people feel welcome, but keep personal conversations out of the arena during a lesson. Focus should always be on the Participants.

Not here for Horse Time - For Lesson Volunteers: Always be attentive to Participants. No petting equine while tied up. Our equine work hard during lessons and require down time. Due to this Volunteers will not have ride time.

Punctuality: Please arrive on time! Our staff and Participants rely on us to be ready for them upon arrival.

Absences: Please notify the Volunteer Coordinator -- at volunteer@soleanastables.org or call/text Sasha (208) 841-9265 at the earliest possible time so that another volunteer can be contacted to fill your slot (ideally at least 24-48 hours in advance). If you are able to find a replacement for your shift this is a great help to our team.

Lesson Cancellation: Lessons will only be canceled if there is extreme cold or heat, or dangerous weather conditions exist. Please do not assume that a lesson is canceled – the Volunteer Coordinator will contact you immediately when a decision is made to cancel lessons.

Do not come into arena until a ​SoléAna Stables staff member says it’s ok.

Attire: Long pants, shorts, leggings are appropriate. A ​SoléAna Stables volunteer t-shirt is mandatory and are $10-$15. No sandals or open-toed shoes are allowed for your safety and the safety of any visitors you may invite to the barn. With colder weather bring gloves and wear warm socks!

Do not wear dangling jewelry. Perfume and cologne should also be avoided.

Bring plenty of water, especially in the summer.

Children/Pets: For safety reasons, unsupervised children are not allowed at SoléAna Stables. Pets are also not allowed. If you have a service animal please contact the Volunteer Coordinator prior to bringing them to the barn.

NON-SMOKING/VAPING FACILITY: SoléAna Stables is a non-smoking facility and has zero tolerance for smoking or vaping on-site.

Confidentiality Agreement

SoléAna Stables operates on the foundation of integrity and respect for the dignity of all people. This statement of confidentiality is to inform all volunteers of their responsibility to ensure that a breach of confidentiality does not occur.

Confidential information includes but is not limited to:

  • Participants' medical records, diagnosis and medical history
  • Participants' financial information
  • Any information in a participants' file regarding family members
  • Volunteer or employees' personal file
  • All financial information about SoléAna Stables
  • All donor & donation information, including but not limited to: address, phone number, email, business, amount of lists, mailing lists, including names, addresses, phone numbers, email addresses and business information donation and purpose.
  • Any network information, including but not limited to: committee members lists, newsletter lists, mailing lists, including names, addresses, phone numbers, email addresses and business information

This information may exist in the form of computer - based systems or written, pictorial, graphic or auditory form.

I agree not to disclose confidential information to third parties not affiliated with SoléAna Stables, except as required by law. I agree not to discuss or otherwise disclose confidential information unless absolutely necessary while acting within the course and scope of my duties. ALL SUCH DISCUSSIONS SHALL BE LIMITED TO ONLY THE APPROPRIATE PERSONNEL AND STAFF WHO HAVE A NEED TO KNOW SUCH INFORMATION IN THE DELIVERY OF PROFESSIONAL SERVICES.

I understand the above statement on inappropriate disclosure of confidential information. I recognize as a staff member, volunteer or participant that corrective actions, up to and including discharge will be implemented if inappropriate disclosure occurs.

Photo and Video Release


The use and reproduction by SoléAna Stables of any other audio / visual materials taken of me for distribution to the public for promotional printed materials, educational activities, exhibitions, including website and other social media or for any other use for the benefit of the program.

Social Media Agreement

SoléAna Stables appreciates volunteers' enthusiasm in sharing the amazing strides our participant’s are taking as a part of this program. However, we ask that you consult with the SoléAna Stables Instructor or Executive Director before posting any videos/pictures or other information on social media. Not everyone in our program is open to sharing their personal experiences on social media and we want to make sure we respect their privacy.

I agree to request permission from the SoléAna Stables Instructor or Executive Director before posting personal videos/pictures or other information online that I may capture or be featured in and/or before referencing SoléAna Stables.


SoléAna Stables - Liability Release Agreement

WARNING UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), AN FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES. The information contained in this application is correct to the best of my knowledge I authorize any references listed in this application to give you my information (including opinions) that they may have regarding my character and fitness for working with minors and individuals with disabilities I acknowledge the risk and potential for risk of working with and around horses I hereby, intending to be legally bound for myself, my heirs and assigns, executors or administrators, RELEASE, WAIVE AND DISCHARGE, SoléAna Stables, a Texas non - profit 501c3 Corporation, its Owners, Employees and Board of Directors, from ALL liability, and any and all possible causes of action in law or in equity that may arise from injury, including but not limited to injury, damage or other misfortune resulting from any recreational or educational activity, including, but not limited to grooming, walking or leading, horseback riding, or group activity which may take place at the stables or at other locations.

I am fully aware that there is an element of risk of injury, damage or other misfortune associated with these recreational and educational activities I accept the risk of such activities, and am aware that such activities are for the recreation, sport, therapy or education, and undertake them voluntarily as the possible benefits are greater than the risk assumed.

I further agree to INDEMNIFY AND HOLD HARMLESS SoléAna Stables, it's Board of Directors, Instructors, Therapists, Aides, Volunteers, and / or Employees / Contractors for any injuries and / or losses I may sustain while volunteering at SoléAna Stables I do hereby for myself, heirs, personal representatives and agents forever release and discharge any claims, demands, actions or lawsuits that may occur as a result of negligent, but not reckless or intentional conduct during my participation.

By signing below, I ACKNOWLEDGE that I enter into this release after having read the same, and place my signature hereto of my own free voluntary act and deed. By signing below, I represent to SoléAna Stables that I fully understand its contents, that I do not need any further explanation, and I waive any further explanation.


Silver Spur Stable Liability Release

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOUR UNDERSTANDING OF AND AGREEMENT TO ITS TERMS BY SIGNING THIS AGREEMENT, YOU (AND YOUR CHILD) ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH OR PROPERTY DAMAGE FOR ANY REASON INCLUDING, BUT NOT LIMITED TO, THE NEGLIGENCE OFTHE TRAINER, THE STABLE, ITS OWNERS,EMPLOYEES AND AGENTS (“THE RELEASEES”).

WARNING

UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), AN EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OFA PARTICIPANT IN EQUINE, FARM, OR FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISK OF EQUINE ACTIVITIES.

Any dispute regarding this Agreement shall be resolved in Brazoria County, Texas using Texas law to govern this Agreement.

In consideration for allowing me (or my minor child) to enter and/or be present upon the premises located at 1226 County Road 45 in Angleton, Texas, and/or in consideration of being allowed to handle, be in the vicinity of and/or ride any wild or domestic animal (including, without limitation)a horse the undersigned agree(s) on his, her, or their own behalf and on behalf of any person present on the premises brought, invited, or permitted to be on premises by the undersigned (including, without limitation, and minor or compromised or any person found by any Court or authority to be incompetent to bindingly execute a release and indemnity on his, her, or their own behalf) and my, our, or their guardian(s), personal representative(s), heir(s), next-of-kin, spouses and assigns,

THE UNDERSIGNED HEREBY:

  1. Acknowledge that a horse or mule may, without warning or any apparent cause, buck, stumble, fall, rear, bite, kick, run, make unpredictable movements, spook, jump obstacles, step on a person’s feet, push or shove a person, saddles or bridles may loosen or break - all of which may cause the rider to fall or be jolted resulting in serious injury or death to the Undersigned or any person within close proximity of a horse.
  2. ACKNOWLEDGE THAT HORSEBACK RIDING, THE HANDLING OF AHORSE OR BEING IN CLOSE PROXIMITY TO A HORSE IS AN INHERENTLY2DANGEROUS ACTIVITY AND INVOLVES RISKS THAT MY CAUSE SERIOUS INJURY AND INSOME CASES DEATH because of the unpredictable nature and irrational behavior of horses, regardless of their training or past performance.
  3. Voluntarily assume the risk and danger of injury or death inherent in the handling or riding of the horse or being in close proximity to a horse or on the premises of the stable or the failure to wear a protective helmet when riding a horse, and use of saddles, bridles, equipment and gear provided to me by Silver Spur Stables, LLC.
  4. RELEASE, DISCHARGE AND PROMISE NOT TO SUE: Silver Spur Stables, LLC for any loss, damage, injury (including death) or cost to me or my child’s arising out of the handling or riding of a horse or being in close proximity to a horse or on the premises of the stable or the failure to wear a protective helmet when riding a horse, and use of saddles, bridles, equipment and gear provided by Silver Spur Stables, LLC.
  5. RELEASE Silver Spur Stables, LLC from any claim that such Silver Spur Stables, LLC were negligent in connection with my or my child’s riding a horse including but not limited to training or selecting horses, maintenance, care, fit or adjustment of saddles or bridles, instruction on riding skills or leading and supervising Participants or the use of any equipment provided by SilverSpur Stables, LLC or being on the premises of the Stable, which resulted in loss, damage, injury or death.
  6. INDEMNIFY, AND SAVE AND HOLD HARMLESS Silver Spur Stables, LLC from and against any loss, liability, damage or cost they may incur arising out of or in any way connected with either my or my child’s handling or riding the horse or being in close proximity to a horse or on the premises of the stable or the failure to wear a protective helmet when riding a horse and/or and use of saddles, bridles, equipment and gear provided therewith from or contributed to by my or my child’s own negligence.
  7. Agree to abide by and follow any instructions given or rules established by Silver SpurStables, LLC is with regard to my or my child’s riding or handling of the horse or being in close proximity to a horse or on the premises of the stable or the failure to wear a protective helmet when riding a horse or any saddles, bridles, equipment and gear provided therewith.
  8. The Undersigned expressly agrees that the foregoing release and waiver of liability, assumption of risk, and indemnity agreement is governed by laws of the State of Texas and is intended to be as broad and inclusive as is permitted by Texas law, and that in the event any portion of this Agreement is determined to be invalid, illegal, or unenforceable for any reason, the balance of the Agreement shall not be affected or impaired in any way and shall continue in full legal force and effect.
  9. Acknowledge that this document is a contract and agree that if a lawsuit is filed againstSilver Spur Stables, LLC for any injury or damage in breach of this contract, the Undersigned will pay all attorney’s, court fees and all costs incurred by Silver Spur Stables, LLC in defending such an action.
  10. IT IS RECOMMENDED THAT I, MY CHILD, AND ALL PARTICIPANTS WEAR A PROTECTIVE HELMET. IT IS MY UNDERSTANDING THAT A PROTECTIVE HELMET IS AVAILABLE AND HAS BEEN OFFERED FOR MY OWN OR MY CHILD’S SAFETY. I (AND FOR MY CHILD) DECLINE TO WEAR A HELMET (PLEASE INITIAL HERE):

I agree to hold harmless, RELEASE, DEFEND, and INDEMNIFY the RELEASED PARTIES of and from all past, current and future claims, causes of action and legal liability that I and/or my minor child(ren) or ward(s), or any person claiming by, through, or under any of them, may have against them including any causes of action for our bodily injuries, death or property damage, even if same are wholly caused as a result of any negligence or gross negligence on the part of any of the Released Parties and even if resulting from any activities not inherent to the risks of equine activities and this agreement to indemnify the Released Parties includes an agreement to indemnify them for any claims brought by any third parties as a result of such above referenced injuries and damages suffered by me (or my minor child(ren) or ward(s)) including any claims brought by any hospital, medical provider, insurance company, governmental agency or any claims by any third party (sued by us for our injuries and damages) seeking contribution from theReleased Parties. If our Guest should suffer any damages for bodily injuries, death or property damage while on Silver Spur Stables, LLC premises and/or while at any offsite event involving any equine activities and/or while traveling with any Released Parties to/from any such offsite event then – even if such injuries and damages are wholly caused by any negligence or gross negligence on the part of any Released parties – I nevertheless agree that (a) if the Guest sues me I shall not see contribution from the Released parties; (b) if the Guest sues the Released Parties I shall defend and indemnify the Released parties for such claims; (c) if the Guest sues a third party who then seeks contribution from the Release Parties I shall defend and indemnify the Released Parties for such claim.

I have read this document. I understand it is a promise not to sue and to release and indemnify the Trainer, the Stable, its owners, employees and agents for all claims. I have made a free and deliberate choice to sign the Release and Waiver as a condition to SilverSpur Stables, LLC allowing me or my child to ride or handle a horse. I have concluded that the risks involved and the Release and Waiver of Liability is worth the pleasure of horseback riding experience and acknowledges that the same is valuable consideration for this Release and Waiver of Liability. I further waive and relinquish all claims of any kind against any person benefitting from this Release and Indemnity and extinguish and relinquish as of the date this instrument is signed, any claim I might have against any beneficiary hereof. I further agree that I, or my estate, shall hold harmless and indemnify any beneficiary hereof from any claims, due, debt liability, judgment, or obligation of any description to any person who is or claims to be entitled to any benefit or recovery of any kind as a result, directly or indirectly, of my presence or their presence, or that of any property owned, possessed or controlled by any of us, on the aforementioned premises or resulting from any activity or condition exiting thereon, including, without limitation, and injury or damages resulting directly or indirectly from any wild or domestic animal, or from any act or omission of any beneficiary hereunder or act or omission of any agent, servant, employee, or representative of any beneficiary of the waiver, relinquishment, release and/or indemnity hereunder.The releases, waivers, relinquishments and indemnities contained herein are in addition to all exemptions under any applicable law benefitting SILVER SPUR STABLES, its owners, managers, agents, servants, employees, or representatives.

NOTICE

Any and all guests or other persons to be admitted to premises by, or at the request of,

or his, her, their, or its agents, servants, employees or representatives must be registered in writing with SILVER SPUR STABLES before coming on premises. Such registration must be approved in writing by the signature of the undersigned.
